By using WaveSleep you agree to these terms. If you don't agree, please don't use the app.

The important ones first

WaveSleep is not a medical device

It plays sound and it records what you tell it. It does not diagnose, treat, cure or prevent anything, and it is not a substitute for advice from a doctor.

The journal shows you what you reported, not what happened to your body. When the app says a mix is one you "have tended to rate highest", that is a description of your own ratings and nothing more — it is not a claim that the mix caused better sleep. If you are worried about your sleep, talk to a clinician.

Do not rely on the alarm alone for anything that matters

The wake alarm uses Apple's alarm system and is designed to ring through silent mode and Focus. It is still software on a device that can be switched off, run out of battery, be left in another room, or fail in ways we have not seen. If missing a wake-up would cause you real harm — a flight, a shift, a medication schedule — set a second alarm. We are not responsible for a missed alarm.

Listen at a sensible volume

Sound played for hours, especially through headphones, can damage hearing. Set it at a level that is comfortable, and be careful with the wake volume, which is deliberately louder than your sleep mix.

Your licence

We give you a personal, non-exclusive, non-transferable licence to use WaveSleep on devices you own, under Apple's standard App Store terms. You may not copy, sell, rent, reverse-engineer or redistribute the app, or extract its sounds for use elsewhere.

The app, its sounds, its design and its name belong to Alpha Original LLC. The mixes and journal entries you create are yours; they live on your device and we have no copy.

WaveSleep Plus

Plus is offered as a monthly or an annual subscription.

What the app expects of you

Use it lawfully, and don't try to break, probe or interfere with it or with other people's use of it.

Availability

We may change, suspend or discontinue features. We will avoid removing something you paid for, and if we have to, we'll say why. The app works offline by design and does not depend on a server we run — but the recorded sounds are downloaded from Apple, and purchases are validated by Apple, so those parts depend on Apple's services.

Disclaimer and liability

WaveSleep is provided "as is", without warranties of any kind, to the fullest extent the law allows. We do not promise it will be uninterrupted or error-free, or that it will improve your sleep.

To the fullest extent permitted by law, Alpha Original LLC is not liable for indirect, incidental or consequential damages arising from your use of the app. Where liability cannot be excluded, it is limited to the amount you paid us for WaveSleep in the twelve months before the claim.

Some jurisdictions do not allow these exclusions, so parts of this section may not apply to you. Nothing here limits rights you have that cannot be waived under the law where you live.

Apple

Apple is not a party to these terms and has no obligation to provide support for WaveSleep. Apple is a third-party beneficiary of these terms and may enforce them.

Changes

If these terms change we will update the date above and the copy inside the app. Continuing to use WaveSleep after a change means you accept it.

Governing law

These terms are governed by the laws of the State of New York, United States, without regard to conflict-of-law rules.

This is the same document that ships inside the WaveSleep app, rendered from the same file, and it is also published at wavesleep.netlify.app. If any two copies ever disagree, the one in the app you installed is the one that governs.

WaveSleep is made by Alpha Original LLC. This is not the AlphaOriginal company privacy policy — that one covers the company and its other products, and lives at alphaoriginal.co/privacy.
